U.S. Supreme Court Justice Antonin Scalia: You Are Kidding Yourself If You Think Internment Ruling Couldn’t Happen Again
(FEDERALJACK) U.S. Supreme Court Justice Antonin Scalia told law students at the University of Hawaii on Monday that the nation’s highest court was wrong to uphold the internment of Japanese-Americans during World War II, but he wouldn’t be surprised if the court issued a similar ruling during a future conflict.
Scalia was responding to a question about the court’s 1944 decision in Korematsu v. United States, which upheld the convictions of Gordon Hirabayashi and Fred Korematsu for violating an order to report to an internment camp.
“Well of course Korematsu was wrong. And I think we have repudiated in a later case. But you are kidding yourself if you think the same thing will not happen again,” Scalia told students and faculty during a lunchtime Q-and-A session.
Scalia cited a Latin expression meaning, “In times of war, the laws fall silent.”
“That’s what was going on — the panic about the war and the invasion of the Pacific and whatnot. That’s what happens. It was wrong, but I would not be surprised to see it happen again, in time of war. It’s no justification, but it is the reality,” he said.
Avi Soifer, the law school’s dean, said he believed Scalia was suggesting people always have to be vigilant and that the law alone can’t be trusted to provide protection.
Soifer said it’s good to hear Scalia say the Korematsu ruling was wrong, noting the justice has been among those who have reined in the power of military commissions regardless of the administration.
“We do need a court that sometimes will say there are individual or group rights that are not being adequately protected by the democratic process,” Soifer said.
Scalia was appointed to the nation’s highest court in 1986, making him the longest-serving justice currently on the court.
The 77-year-old spoke after teaching a class. He didn’t take questions from media.

Columbia, MO November 30, 2010 – What happens during a national emergency? People know that the President of the United States would be the one to declare the emergency, but under what criteria? What about our Constitutional Rights during the emergency?
Film maker William Lewis had the chance to sit down with former police officer turned whistle-blower Travis Maddox for an interview contained the newly released film Enemy of the State: Camp FEMA Part 2. During the interview, Maddox shares what became his concerns about the extensive training given to the local police department by the Department of Homeland Security in case of a nuclear, chemical, or biological attack.
Maddox, also a former Missouri Constitution Party candidate for office, says the group in which he participated was “trained” to force people from their homes, disarm them, load them onto buses for transport to secured quarantine areas, “and if that weren’t enough, from there it gets pretty scary,” says Lewis of the interview.
“DHS, parent organization for the Transportation Security Administration, could give the TSA a run for their money,” relays Lewis about the information given the viewer from Maddox’s first hand experience during training. The procedures for decontamination require removal of clothing, by force, if necessary. Maddox also stated during the interview that when the order is given, no one will have a choice, basically saying that you lose your rights to your private property, your guns, even your own body.
“I think your body is probably the most private property that you own,” Investigative Journalist and radio talk show host Kaye Beach said in reference to the possibility of forced treatment in this fourth film by the Lewis/Franchi team.
Along with the police state-type tactics described by Maddox, Enemy of the State guests Ernest Hancock and Beach discuss the paperwork in place in Arizona and Oklahoma that could bring about forced treatment in the case of a biological attack. Massachusetts already passed laws to force treatment during the Swine Flu scare in 2009. Beach actually discusses that there may be something similar in nearly every state, as most have adopted either all or part of the Model State Emergency Health Powers Act.
CBS released a 3-month study in late October 2009 showing that state-by-state, the odds of people actually testing positive for the Swine Flu were very slim. Franchi says, “That means that the National State of Emergency called by President Obama was, in fact, based on false data.
Lewis and Franchi have produced four films altogether exposing FEMA, the Department of Homeland Security and egregious legislation in an attempt to help those in the United States see the horrors awaiting We-the-People from our out-of-control government. The Fall 2010 SPLC Intelligence Report is out and it does not disappoint. In the article “’Patriot’ Paranoia: A Look at the Top Ten Conspiracy Theories,” writer Alexander Zaitchik speaks about the ”unceasing march of disparate conspiracy-based movements that…have trembled before and warned against imaginary threats posed by Catholics, Mormons, Jews, American Communists, Freemasons, bankers, and U.S. government officials and agencies.” He continues that these conspiracy theories have seen a resurgence within the “extreme right.”
Listing what they consider the Top Ten Theories, number three is FEMA Concentration Camps. The newly released William Lewis/Gary Franchi film, Enemy of the State, Camp FEMA Part 2, adds more fuel to the fire of truth exposed in Camp FEMA Part 1: American Lockdown, and points out what the Southern Poverty Law Center refuses to admit.
In the new film, James Lane takes viewers to the Lucent Technologies Building, used to house Hurricane Gustav refugees. He points out that the building has a turnstile type entry as well as gates that can be closed and locked down. He also observed how the building could be easily locked down in a matter of hours to confine scores of people. Apparently, the Southern Poverty Law Center does not remember our history, the detaining of tens of thousands of US citizens during World War II. While they and the government would have you believe everything is innocent, the precedent has been sent.
Door to door gun confiscation is number five on their list. Apparently the SPLC doesn’t remember the door-to-door trek by local police and the National Guard to remove people from their homes and the confiscation of their guns in New Orleans during Hurricane Katrina. Enemy of the State exposes the training that police departments have received from the Department of Homeland Security, under which FEMA was moved. Trainee Travis Maddox tells about the forced removal of United States citizens from their homes, the mandatory stripping down for decontamination and the compulsory vaccination of each member forced into a quarantine area during a chemical or biological attack.
